The terms that apply to orders placed with MotoIntell.
Contracting entity
Sales through this website are contracted with LING FENG AUTOMOBILE CO., LIMITED, a company registered in Hong Kong (Business Registration No. 80508133, registered address RM 18, 2/F, TUSPARK, 118 Wai Yip Street, Kwun Tong, Hong Kong). MotoIntell is its export brand. Where a supply agreement names a different selling entity, that entity is stated on your proforma invoice and contract.
Quotations and orders
Quotations are valid for the period stated on them, and are subject to stock and factory availability. A quotation is not a binding offer; a contract is formed when we issue a proforma invoice or sales contract and you pay the deposit.
Prices and payment
Prices are FOB unless stated otherwise. Payment terms are a 20% deposit to confirm the order and the balance before shipment, under the terms described in Payment Methods. Where a payment is late, the shipment date may change accordingly.
Delivery and risk
Delivery dates are estimates and depend on factory availability, shipping schedules and port operations. Risk and cost pass to the buyer in accordance with the Incoterm stated in the contract. Title passes on receipt of full payment.
Warranty and claims
The warranty terms in our Warranty Policy apply. Claims must be made within the warranty period and supported by the evidence described there. Vehicles are not returnable after shipment, as set out in Cancellation and Returns.
Limitation of liability
Our liability for any order is limited to the invoiced value of the vehicle concerned. We are not liable for indirect or consequential losses, including loss of profit, loss of use, storage charges, or duties and taxes paid at destination.
Force majeure
We are not liable for delays or failure to perform caused by events beyond our reasonable control, including factory shutdowns, shipping line schedule changes, port congestion, strikes, customs or regulatory action, and natural disasters.
Governing law and disputes
These terms are governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China. The parties will first attempt to resolve any dispute through negotiation in good faith; unresolved disputes may be referred to arbitration in Hong Kong.
